Expunge Solano County Arrest Records

Under Penal code §1203.4, a record may be expunged if probation was part of the sentence. Penal code §1203.4(a) provides for expungement of cases in which there was no probation while Penal code §17 provides for reduction of a felony conviction to misdemeanor which may then be dismissed.

Generally, the court will expunge an arrest record if:

a). The individual received probation for the conviction and:

  • Successfully completed probation or obtained early release.
  • Have paid all restitutions, fines, and reimbursements as ordered by the court as part of the individual's sentence
  • Not currently charged with another offense.

b) the individual never received probation and:

  • The conviction was a misdemeanor
  • It has been at least one year since the date the individual was convicted.
  • The individual has complied fully with the sentence of the court
  • The individual is not currently serving another offense
  • The individual has obeyed the law and lived an honest life since the time of conviction.

Upon satisfying the above requirements, the individual may then obtain a copy of the case information for the conviction he wishes to be expunged, then fill out some forms as will be provided by the court with the details of the case to be expunged. The individual will then pay a fee not more than $120 depending on the case to be expunged or use the option of fee waiver if eligible.

The individual then obtains the Petition for Dismissal and the Order for Dismissal forms to complete the petition. Typically, an expungement takes between 4 weeks to 4 months depending on how busy the court calendar is.

Similarly, an arrest that did not result in a conviction may be sealed for an individual under the Penal Code section 851.91. This applies to the following:

  • An individual was arrested, but no charges were filed
  • An individual was arrested and charged, but the charges were dismissed
  • An individual completed diversion, and the charges were dismissed
  • An individual completed “DEJ" (deferred entry of judgment) and the charges were dismissed
  • An individual went to trial and was found guilty.

On any of these instances, an individual may request a court to seal such arrest records. On the agreement of the judge, the arrest records will no longer be available to the public.

Solano County Arrest Warrants

An arrest warrant is a written directive signed by a judge that permits an officer of the law to arrest a suspect. An arrest warrant may be issued upon a grand indictment by the jury or when a district attorney files a criminal complaint following a police report.
