Lassen County Arrest Records Vs. Criminal Records
Lassen County arrest records document the interaction between a person and law enforcement. In contrast, criminal records record the complete judicial process a person experiences from the point charges were made to the disposition. Other differences include:
Arrest Records | Criminal Records |
---|---|
Includes the arrest date, arresting agency, initial charges, booking number, and bail amount | Includes all the charges filed, pleadings, trial or plea outcomes, sentencing details, and probation/parole records |
Records are retained indefinitely in the sheriff's records unless erased | Records are retained by the courts indefinitely. The courts may expunge convictions |
They are updated with subsequent arrests by law enforcement | They are updated at each new stage of the case through the court system, capturing the outcome of each stage up to post-conviction actions |
They are generally public, but in some instances, authorities restrict public access | They are public records unless sealed or confidential by law. |
How Long Do Arrests Stay on Your Record?
In Lassen County, arrest records are retained indefinitely by state law enforcement agencies unless the individual with the record successfully petitions to have the record sealed or expunged. California Government Code § 7923.610 requires law enforcement to maintain these records. For example, records such as arrest logs and booking data remain in the Lassen County Sheriff's Office databases unless expunged or sealed. Where a petitioner's request for sealing records is successful, the records are removed from public view but will remain accessible to certain licensing bodies and law enforcement.
The concept of expungement in California is referred to as set-aside and sealing.
Persons are eligible for set-aside if:
- They have fulfilled the conditions of their probation for the entire period, including payment of court-ordered restitution.
- A court discharges them before the termination of the probation period.
- A court case grants the person a set-aside.
Eligibility waiting periods for set aside are from one to four years, and the only offenses excluded from set aside are offenses that require sex offender registration.
Lassen County Arrest Warrants
In Lassen County, an arrest warrant is a written order issued by a magistrate or judge that gives law enforcement the right to detain the person named on the warrant. A court with jurisdiction issues a warrant after a law enforcement officer, such as a Sheriff deputy, swears an affidavit before the judge or magistrate, with the affidavit establishing probable cause. Arrest warrants typically include information such as the person's full name, date of birth, physical description, alleged offense, and charges.
Persons in Lassen County who find out there is an active warrant for them can choose to turn themselves in to law enforcement, schedule a court appearance, or consult with an attorney to address the warrant.
Do Lassen County Arrest Warrants Expire?
In California, including Lassen County, arrest warrants do not expire. They remain valid until law enforcement executes or quashes them, or the issuing court dismisses or recalls the charge. California law does not impose an expiration date or validity period on arrest warrants. Thus, any warrant issued in Lassen County will remain enforceable in perpetuity.
Expunge Lassen County Arrest Records
By California law (California Assembly Bill No. 145), Lassen County non-conviction records dating back to 1973 are automatically sealed. However, sealing is not available for persons who law enforcement may still charge with any offenses from the original arrest or for those who intentionally evade law enforcement's attempts to prosecute them for their arrest.
Petitioners can apply to seal non-conviction records at any time at the court where they were prosecuted or at a court with criminal jurisdiction in the same county. Sealing is mandatory for petitioners except for arrests for child abuse, elder abuse, or domestic violence, or if there is a pattern of related arrests or convictions.
Persons authorized for drug diversion programs organized by the superior court have their records approved for sealing. Also, persons charged with a misdemeanor who have admitted to and completed a deferred entry of judgment program, as ordered by the district attorney, may have their arrest records sealed by a judge.
Detention facilities must post information informing detainees of the availability of sealing of their records as they meet the requirements.
Once the Superior Court seals a record in Lassen County, the authorities consider the arrest as if it never happened, and the petitioner is released from all disabilities and penalties imposed due to the arrest.
